TERMS & CONDITIONS

BIDDER TERMS & CONDITIONS:  Please be advised that all bidders must read and accept the Terms and Conditions of this sale prior to bidding. By placing a bid, you agree to the terms and conditions forming a sale contract between​ the successful bidder(purchaser), Toys Of Times Past Auctions and the consignor(seller).

TERMS OF SALE: :  When bidding on any lot offered by Toys of Times Past the bidder indicates acceptance of the following Terms & Conditions of Sale. Any participation in the auction binds you to agreement to these terms whether or not read or understand said terms and conditions.​

REGISTRATION: All bidders must pre-register with Toys of Times Past to receive a Bidder ID prior to the last day of the auction. Please register online at www.toysoftimespast.com or call 216-218-1971. A credit card number is required for bidder registration.

BIDDING: You may bid as high as you want over the minimum bid.

LIVE ONLINE BIDDING: An online only auction takes place solely online. Online bidding and catalogs are available at www.toysoftimespast.com, Liveauctioneers and Invaluable/Auctionzip. Catalogs are posted about 3 weeks prior to the auction end date for bidders to place bids. During this period of open bidding, bidders are able to see the current high bid on each lot.  You may place higher bids during this time. On the auction end date, the auction will go LIVE ONLINE ONLY for bidders to bid live during the online only auction until it has ended.  Bidders are automatically informed live during bidding  if they are the high bidder or if they have been outbid by another competing bidder. 

ABSENTEE BIDDING: Bidders may place absentee bids for the items they are interested in online, by email or phone. Toys of Times Past will execute your bids on your behalf during the live auction. For example: If lot #10 has a bid of $50 and your absentee bid is $100, Toys of Times Past will competitively place bids for you, up to your $100 absentee bid.

VIA MAIL: Please submit completed and signed Bid Form. Mail and Email bids can be confirmed by calling 216-218-1971.

BIDDING INCRIMENTS:

Up to:

$1-$49 / $5

$50-$249 / $10

$250-$999 / $25

$1,000-$2,499 / $50

$2,500-$4,999 / $100

$5,000—$9,999 / $250

$10,000-$19,999 / $500

$20,000++ / $1,000.​

BUYERS PREMIUM: 23% buyers premium will be added to all purchases paid for with Visa, MasterCard, Discover, American Express or Debit. A 3% discount will be applied to all purchases paid for with Cash, Check or Money Order (discounted to 20%).

SALES TAX: Ohio residents must pay Ohio sales tax unless you have an Ohio sales tax exemption number. You must fill out a Sales Tax Exemption form and submit a copy of your Department of Taxation Tax Exemption License. If purchase is shipped out of the State of Ohio, the purchase is exempt from Ohio sales tax. Bidders picking up items from out of state are subject to 8% Ohio sales tax.

PAYMENT: Visa, MasterCard, Discover, American Express, Debit, Cash, Check or Money Order are accepted. All checks will be held for 10 business days prior to shipping the purchase. Invoices with be sent within 7-10 days after the close of auction. Payment in full must be received within 7 calendar days after receiving invoice.

SHIPPING: Worldwide shipping available. All items are packed in house and shipped fully insured and the buyer is responsible for the insured shipping cost. International customers are responsible for all customs and import fees associated with your country. Although we take great time and care in packing, if an item is damaged in shipment, please notify us immediately. All packing materials, shipping boxes and damaged item(s) must be kept, otherwise we will not be able to process an insurance claim. We can not be held responsible for making a claim if these instructions are not followed.

RETURNS: If payment is made within the due date of 7 calendar days of receiving the invoice, Buyer must notify Toys of Times Past  with the problem within 3 days after receiving the item. If the return is authorized, the item must be returned with full insurance so that it arrives in our possession within 7 days of the return authorization. The returned item must be received in the same condition as originally sent; otherwise, this policy is void. No refunds will be issued if a return authorization from Toys of Times Past has not been issued. A refund of the purchase price minus all shipping costs will be issued only if the item was grossly misrepresented. No returns will be accepted for any reason if payment was not made within the due date of 7 calendar days of receiving the invoice. 

ABREVIATIONS: M=Mint (Flawless condition/Like new); NM=Near Mint (Very slight playwear and/or box storage wear) ; EX+= Excellent Plus (May show slightly more wear than NM but still retains bright, glossy finish); EX=Excellent (Shows light playwear and scratches); VG=Very Good (Shows heavier playwear, more defects & fading but still displayable) , G=Good (Obvious overall wear with possible missing parts), F=Fair (Extensive damage, wear and possible missing parts); BO=Battery Operated; BORC=Battery Operated Remote Control; FR=Friction; HBP=Hanna Barbera Productions; KFS=King Features Syndicate; OB=Original Box; PS=Pressed Steel; WDP=Walt Disney Productions; WS=Wingspan; WU= Windup.

In publishing the online catalog, Toys of Times Past  tried to accurately describe all items being sold. All items are sold AS IS - WHERE IS. It is the bidder’s responsibility to judge condition. If you have questions, please ask. No statement in this catalog shall be deemed to be a warranty or representation of the items being sold and Toys of Times Past will not assume liability with respect to age, condition, rarity, provenance or historical relevance of the items being sold. Any agent under the employ of any bidder is bound by the terms of sale as stated in the online catalog and any relevant documents.

Toys of Times Past has the right to refuse any bid from anyone at any time for any reason.

Toys of Times Past is not responsible for any errors in executing any mail, email or phone bid and is providing this service for the convenience of the customers only. Toys of Times Past is not responsible for typographical errors or omissions in online catalog. Toys of Times Past assumes no liability for withdrawing any lot and has the right to pull any lot at any time prior to the end of the auction.

If there is a system failure or failure in the auction bidding process, Toys of Times Past reserves the right to reschedule the auction end-date.

Title to all merchandise shall pass to the highest bidder at conclusion of bidding. The purchaser is fully responsible once title has been passed. The payment due date is within 7 calendar days of receiving the invoice. Storage and insurance charges shall accrue at the rate of 4% of the selling price per month after 30 days.
